I, the Buyer do hereby agree to buy the above mentioned Canine, and agrees to the following terms and conditions:

The Canine listed above appears to be in good health at the time of the sale, and embodies the characteristics of the breed listed above. This canine is ACHC registered with AKC and APRI purebred parents. The breeder believes the above described canine to be in good health at the time of delivery.

The seller requires this canine to be seen by your local veterinarian within 72 business hours from the time of delivery or pickup. Failure to do so will void this contract and its guarantee. If within those 72 hours the puppy is found to have a life-threatening defect, the buyer may return the puppy for a replacement puppy (with equal or lesser value; with the same coat, color, and gender) as soon as one comes available. During the initial exam, should your veterinarian find the puppy to be a poor health risk, or detect any physical health problems that would require further veterinarian care (excluding required vaccinations and deworming) you must notify the seller about results within 24 hours. A diagnosis of coccidiosis, giardia, parasites, kennel cough or any other type of bacterial infection does not render the puppy unhealthy. If a licensed veterinarian determines the puppy to be in poor health the breeder must be contacted within 2 days with the licensed veterinarians determination and have 2 reports from 2 unassociated veterinarians stating the same problem and seller will provide a replacement puppy of equal or lesser value. If buyer has decided to return a puppy (with defects such as those listed above) and seller has been notified, the puppy must be returned to the seller within 2 weeks of written notification to the buyer. Buyer is responsible for all transportation costs to and from the seller on a replacement puppy. The buyer is responsible for all expenses in the return of the puppy. No refund will be given to the buyer for vet costs. If the buyer decides to keep a puppy in the event of a defect being found (and does not make arrangements to return the puppy within 2 weeks of notification of defect) the seller no longer has any obligations to replace the puppy at any later date. If the puppy is returned due to life altering defects (those listed above), and if the sellers vet agrees to the diagnosis of condition after conferring with the buyer’s vet, then a replacement will be issued as soon as one comes available.

No replacement puppy or refund will be given if puppy has been euthanized without the sellers permission. In the event of the puppy’s death a necropsy must be performed to determine the cause of death. The breeder is in no way responsible for payment of this exam, or any other medical or veterinarian charges. The buyer understands that the

breeder offers no cash refunds. If the buyer qualifies for a replacement puppy then the purchase price will be put towards another canine of equal or lesser value when one becomes available. Under no circumstances will a refund be made in lieu of a replacement. If the buyer rejects a replacement puppy, all sales become final. Under NO CONDITION will the breeder replace this canine where the breeder was not advised of its being ill beforehand or “Put to sleep” without the breeder’s permission. Hip, elbow, and knee dysplasia can be a result of environmental problems such as lack of proper nutrition, exercise, slick floor surface, being allowed to jump down or falling off of taller structures or rough housing with other pets or humans. Due to this Seller cannot guarantee hip, elbow, or knee dysplasia beyond the initial health check. Both parents have been health and genetic tested with not underlying issues.

We guarantee that all appropriate shots for the canine’s age have been given, and a record of this vaccination history is supplied at the time of delivery. We guarantee this puppy to be free of genetic defects until the puppy reaches one year of age. __________________ We guarantee this puppy is from AKC/APRI purebred parents.

The Buyer agrees to maintain the canine’s health in good condition, and to provide yearly examinations, vaccinations, heartworm, grooming, and any other usual procedures necessary to assure good health. The Breeder has done everything possible to produce healthy sound canines in the best way possible in regards to diet, exercise, socialization and veterinary care. The Buyer agrees to provide a suitable and safe area for this canine. The Breeder will not be responsible for Parvo, Distemper, or Corona Virus after 48 hours of the sale, as these are highly contagious diseases and can be contracted immediately after the breeder. The Breeder does NOT cover any liability for any injury, or illness caused by stress induced hypoglycemia, canine influenza, pneumonia, parasites internal or external, ringworm, coccidiosis, giardia, hepatitis, other disease/illness/viruses, or mites after leaving our care. There are all types of parasites that lie dormant and that can be brought on by stress or change of environment due to allergies etc., and there is no way to predict how a puppy will cope with the change. This is why the buyer agrees to not change the puppy’s dog food for at least 1 week after pickup as to not stress the puppy more than necessary. Also there is no guarantee against any diseases after leaving Circle C Puppies premises. I do my best to provide a clean, healthy, safe environment and to ensure that the buyer is getting a healthy pup.

The Breeder/Seller can offer no further guarantees once the care of the canine is no longer under their control. Circle C Puppies only guarantees a pet quality dog and in no way implies or guarantees the ability to breed or show the dog. Therefore, the breeder does not make any guarantees as to the canine’s adult size, weight, hair color, skin conditions, temperament, or train-ability of the canine. The breeder neither makes or implies any warranties or guarantees under this contract except those stated above. If there are any disagreements or discrepancies, they must be handled in the State of Missouri and the County of Barton, at the buyer’s expense in regards to all legal fees.

By the signature below the purchaser acknowledges that she/he has read, agrees, and does understand all the conditions of this contract and agrees with the sales agreement.
